We are far short of the necessary number of votes to amend our Bylaws and CC&Rs. 
If you have not voted, or voted "no," please read this message. 

What are Bylaws?


The Bylaws of a corporation specify the rules under which the corporation must operate.  Your homeowners association is a California corporation and it must operate in accordance with its Bylaws.  The proposed amendments to the Bylaws update these documents that were initially drafted over two decades ago.  To view a copy of the proposed Bylaws, please click this link:  "Restated Bylaws" (pdf).

What are CC&Rs?


When a community such as Jasmine Street is built, the developer adopts and records with the County Recorder a set of rules relating to the use and maintenance of the properties in the development.  These rules are called Covenants, Conditions & Restrictions, or "CC&Rs" for short.  The CC&Rs are agreed-upon standards for maintenance of common areas within the community, and standards to ensure that individual properties achieve a minimum level of care to maintain the aesthetic appeal of the community, and thus preserve and enhance property values.  The existing CC&Rs consists of several documents cobbled together over the years as each phase of Jasmine Street was developed.  The streamlined, updated CC&Rs (pdf) document combines all the existing material into one document and updates some provisions to current law. 

How many votes are needed?


Because both Bylaws and CC&Rs are such important documents, they are drafted with a relatively high requirement to change them.  The Bylaws require 51% of the members, or 158 votes.  The CC&Rs have an even higher threshold, requiring 75%, or 231 votes.  Since the Restated and Amended Bylaws and the Declaration of Restrictions are written as a set with cross-references to provisions in both documents, they must be adopted together and one will not be adopted without the other.  Therefore, the 75% requirement, in effect, applies to both.  We are about half way there.

If you have not already done so, please send in the ballot to vote on this important improvement to your Association's operation. 

  • If you are not sure if you have voted, vote again as only the latest dated vote counts. 
  • If you sent in your ballot without selecting either option "yes" or "no" then the vote only counts to achieve a quorum.
  • You are strongly encouraged to  re-submit your ballot to vote in favor of the amended documents. 

Again, only one ballot will be counted and that will be the one with the most recent date in the case of two or more from the same owner for the same property.
